A 43-year-old man convicted of assaulting his wife into a coma smiled when the Court of Appeal increased his jail sentence to 14 years
Rosmaini Abdul Raof had previously been sentenced to 10 years in prison for causing grievous hurt to Jahidah Nordin @ Sylvester, 48.
In a ruling today, a three-judge panel led by Datuk Azman Abdullah unanimously increased the sentence imposed by the Sessions Court and upheld by the High Court, reported the New Straits Times.
The panel described the 10-year imprisonment was insufficient for a violent domestic case, in which a husband attacked his pregnant wife, leaving her in a coma.
Jahidah is currently in a vegetative state, while her son, now 4-years-old, delivered via caesarean section when she was in a coma is experiencing developmental issues. He has also been certified as disabled.
"The victim is described as a 'living corpse', requiring full-time care for years with no prospect of recovery, while Rosmaini has completely failed to provide any assistance or support to the victim after the incident.
"The victim was in a vulnerable state due to her pregnancy and Rosmaini showed no remorse, instead choosing to proceed to a full trial.
"All these factors, when viewed cumulatively, place this case at the highest level of seriousness within the spectrum of the charges," said Datuk Noorin Badaruddin, one of the judges on the panel.

When a court officer explained the enhanced sentence to Rosmaini, he smiled after indicating that he understood his fate
He was immediately led out of the courtroom.
Rosmaini was charged under Section 325 of the Penal Code for causing grievous hurt, read together with Section 326A of the same Code.
In March 2023, the Seremban Syariah Lower Court granted Jahidah's family to annul her marriage to Rosmaini.
Just last week, Rosmaini was arrested for a separate domestic abuse case.
He allegedly assaulted his current pregnant wife in Kedah, causing her to miscarry.
Asking for help is not a sign of weakness.
