The Petaling Jaya Sessions Court has sentenced 30-year-old Ismanira Abdul Manaf, the mother of 6-year-old autistic boy Zayn Rayyan Abdul Matiin, to five years in prison
She was found guilty of neglecting her son, whose body was discovered in a stream on 6 December 2023, about 200m from their home at Block R, Apartment Idaman, Damansara Damai.
Judge Dr Syahliza Warnoh handed down the sentence after hearing submissions from both the defence and prosecution, reported FMT.
The court also ordered Ismanira to sign a two-year good behaviour bond with one surety and a security of RM3,000, and to perform 120 hours of community service within six months after completing her prison term.
Her application for a stay of execution was rejected, with the judge ruling that there were no special circumstances to justify it.
Earlier, the court found that the prosecution had proven its case beyond a reasonable doubt under Section 31(1)(a) of the Child Act 2001, which covers child neglect likely to cause physical harm
The offence carries a penalty of up to 20 years' imprisonment, a fine of RM50,000, or both.
Ismanira and her husband, Zaim Ikhwan Zahari, were charged last year with neglecting Zayn Rayyan in a manner likely to cause him physical harm.
The incident took place between noon on 5 December 2023, when Zayn Rayyan was reported missing, and 9.55pm the following day.
Zaim Ikhwan was acquitted in July this year after the court ruled that the prosecution had failed to establish a prima facie case against him.
