Melaka School Gang Rape: One Teen Pleads Guilty, Another Denies All Charges

Two Form 5 students accused of gang-raping a Form 3 girl at a school in Alor Gajah, Melaka, were charged at the Alor Gajah Juvenile Court yesterday, 16 October
The two 17-year-olds were charged under Section 375B of the Penal Code for gang rape, Section 377B for committing carnal intercourse against the order of nature, and Section 14(a) of the Sexual Offences Against Children Act 2017 for sexual assault on a child.
The alleged offences took place inside a classroom around 2.50pm on 30 September.
According to Bernama, one of the accused pleaded guilty to all three charges, while the other denied the charges and claimed trial.
Both defendants appeared in court accompanied by their lawyers and parents.

However, the first accused, represented by lawyer Chua Yong Yi, requested a lower bail, citing her client's health issues following a recent sinus surgery and a hernia.
The lawyer added that the teenager is the eldest son in the family, and that his father, a civil servant, has to bear the living expenses of his other two children.
The second accused, who pleaded guilty, was represented by a National Legal Aid Foundation lawyer.
His counsel also asked for a lower bail, citing that he was raised by a single mother and assured the court he would follow all bail conditions.
Magistrate Dr Teoh Shu Yee allowed bail at RM7,000 each — RM4,000 for the first charge and RM1,500 each for the second and third charges
The court also fixed 26 November for case mention, allowing the submission of documents for the first accused and a probation report for the second accused before sentencing.
China Press reported that the two teens became emotional after the proceedings and were seen crying and hugging their parents outside the court.
As they were minors, the media was barred from photographing the defendants in court.
Under Section 375B of the Penal Code, the accused face imprisonment of between 10 and 30 years.
Under Section 377B and Section 14(a) of the Sexual Offences Against Children Act 2017, those found guilty face up to 20 years' jail and whipping.
