“It Was A Misunderstanding” — Chinese Tourist Who Hit Immigration Officer Jailed 1 Month

A Chinese tourist who injured an immigration officer at the Kuala Lumpur International Airport (KLIA) Terminal 1 departure hall last week has been sentenced to one month in jail and fined RM2,000
The accused, 31-year-old Fang Fuyuan (transliterated from Chinese), pleaded guilty at the Sepang Magistrate's Court yesterday, 18 August, to voluntarily causing hurt to a public servant, reported Sin Chew Daily.
According to the charge sheet, the incident took place around 8pm on Wednesday, 13 August, when Fang was instructed to step aside at the immigration counter.
She reacted by assaulting officer Nurdiana Atirah Shapinaz Abdul Rahman, who suffered a concussion, injuries to the left side of her face, and swelling under the eyes.
Fang was charged under Section 332 of the Penal Code, which carries a maximum penalty of three years' imprisonment, a fine, or both.

Fang's lawyers pleaded for leniency, stating that their client regretted her actions, admitted guilt at the first mention, and cooperated fully during investigations
They added that Fang, a first-time offender with no prior criminal record, is the mother of two young children aged 1 and 5, who depend entirely on her.
"This incident arose from a misunderstanding and communication problem with the immigration officer. It happened spontaneously and was not premeditated," they said, as quoted by Berita Harian.
They requested that the court impose only a fine since she had already been remanded for five days.
Deputy public prosecutor Luvithaa Veerasamy, however, urged the court to impose a deterrent sentence.
"Although the accused claimed she acted out of emotion, her actions still injured a public servant. The court must send a clear signal that such offences cannot be accepted by society," she said.
After considering both sides, Magistrate Khairatul Animah sentenced Fang to one month in prison and fined her RM2,000, with an additional two months' jail in default of payment
The court ordered her sentence to take effect from the date of her arrest on 13 August.
