Mohd Daniel was charged with cruelly kicking and throwing a kitten, causing its death, at an apartment in Section U16, Shah Alam, between 4.50am and 5am on 3 October 2025

According to facts of the case, the accused had found two kittens in front of his house, placed them in a bag, and brought them to the front of a neighbour's unit before throwing them onto the ground.

He then took the kittens out of the bag and kicked both animals before placing one of them on the kitchen wall of his neighbour's house.

His actions were captured on closed-circuit television (CCTV), and the footage later circulated on social media.

Following a complaint, officers from the Selangor Animal Welfare Office visited the scene at about 9.15pm on the same day and found that one of the kittens had died and been buried.

A post-mortem later revealed that the kitten suffered a cracked skull, bleeding in the lungs, and fractured ribs, causing its death.

The accused was charged under Section 29(1)(a) of the Animal Welfare Act 2015 [Act 772], which is punishable with a fine of between RM20,000 and RM100,000, imprisonment of up to three years, or both.

During mitigation, defence lawyer Amirah Badriyah Azahar requested a lighter jail sentence, saying her client could not afford the fine and suffers from high blood pressure and chronic migraines

She said the accused works as a mechanic earning RM1,700 a month and supports a non-working wife, a seven-month-old baby, and his 70-year-old father, who is ill.

She added that several stray cats frequently defecated in front of his house, which he often cleaned, leading to disputes with his neighbours. He had also lodged complaints with the apartment management, but no action was taken.

"The situation caused prolonged stress, and the accused lost his judgement. In an emotional and angry state, he kicked and threw the kitten," she said, adding that her client now regrets his actions.

The prosecution was represented by Selangor Veterinary Services Department prosecuting officer Mohd Sharif Sabran, who urged the court to impose a heavier sentence as a lesson to both the accused and the public against mistreating animals.
