Genting Founder’s Grandson Clears Hurdle In Bid To Remove RM1.6 Bil Estate Administrators

He claimed that the court-appointed administrators had overstepped their duties in handling his late mother's estate.

The Kuala Lumpur High Court has ruled in favour of one of Genting founder Tan Sri Lim Goh Tong's grandchildren, allowing his bid to suspend two court-appointed interim administrators from managing his late mother's RM1.6 billion estate to be heard

In a decision delivered yesterday, 26 February, Judicial Commissioner Mahazan Mat Taib dismissed a preliminary objection raised by Datuk Satharuban Sivasubramaniam and Khoo Siew Kiat, who were appointed as administrators pendente lite (APLs) to oversee the estate of the late Lim Siew Kim.

Siew Kim, Goh Tong's youngest daughter, died of stage four ovarian cancer in July 2022 at the age of 73. Her estate has since been the subject of an ongoing family dispute lasting more than two years.

The probate suit before the High Court centres on an inheritance dispute among her four children. Two of her daughters, Chan T'shiao Li, 48, and Kimberley Chan T'shiao Min, 45, are seeking to invalidate their mother's last will.

On 27 November 2023, the High Court appointed Satharuban and Khoo as APLs to manage the estate while the dispute is being resolved.

However, Siew Kim's son, Marcus Chan Jau Chwen, later filed an application seeking the APLs' removal, alleging that they had acted beyond the scope of their authority.

He alleged that certain payments were made to solicitors and other parties using personal bank accounts instead of consolidated trust accounts, that estate funds were depleted through improper disbursements, and that the administrators interfered with the management of companies linked to the estate, reported Bernama.

Marcus further claimed that the administrators had nearly caused the estate to pay RM4.73 million in tax assessments on behalf of Prominview Sdn Bhd, even though he alleged the liability should have been borne by a joint venture partner.

In response, Satharuban and Khoo, represented by counsel B Thangaraj, sought to strike out Marcus's removal application at a preliminary stage

They argued that Marcus's legal team had improperly introduced new matters in their written submissions that were not included in the original affidavits, effectively attempting to have the application dismissed on procedural grounds.

Meanwhile, Marcus proposed several independent professionals as potential replacements, including Victor Saw Seng Kee and Surendran Sathya Seelan of PricewaterhouseCoopers Advisory Services Sdn Bhd, or Lok Peng Chuan of KPMG Corporate Restructuring PLT, reported The Edge.

Speaking to SAYS, Marcus's lawyer Goik Kenwayne said his client was concerned that the administrators had exceeded the limits set out in the court order appointing them

Earlier developments in the case saw the High Court grant Marcus permission on 30 September 2025 to proceed with his applications to remove the administrators and seek an injunction.

The administrators appealed that decision, but the Court of Appeal dismissed the appeal on 8 January 2026, upholding the High Court's ruling.

On 23 January 2026, Marcus also secured an interim injunction preventing the administrators from acting on behalf of the estate until the court decides on the removal application.

The High Court will continue hearing the removal application next Wednesday, 4 March.
