Family Feud: Court Orders Siblings To Pay Eldest Brother RM30K In Dispute Over Dad’s House

The High Court has dismissed a suit by three siblings against their eldest brother over a family home in Petaling Jaya, ruling that their late father had willingly transferred the property to him before his death
According to FMT, Justice Khadijah Idris ruled that the late father had voluntarily transferred the RM350,000 house to his eldest son, S Selvakumar, 47, before his death.
The transfer took place in December 2016 and was officially registered in March 2017, six months before the father's death in September that year.
The court also found no evidence that he did not understand the transaction.
"The father made the transfer willingly, in the presence of a land officer, who confirmed the father understood the nature of the transfer and was of sound mind at the time," said Justice Khadijah.
In her judgment, she ordered the plaintiffs – S Krishnan, 46, S Vijayan, 44, and S Mageswari, 40 – to pay their brother RM30,000 in costs.

The siblings had filed the suit in 2020, claiming their father wanted their Taman Medan house to be sold and the proceeds shared equally
They alleged the transfer was made without their knowledge and accused Selvakumar of deceiving their father, who was ill at the time.
Selvakumar, a driver, denied any wrongdoing and said their father gave him the house as he was the only child who stayed to care for him after their mother died in 2015.
The family consists of four brothers and one sister. Court filings also showed that another brother had previously received a separate property in Banting from their father through a lawyer.
