Artist Ernest Zacharevic Sues AirAsia Over Unauthorised Use Of His Artwork

Internationally recognised street artist Ernest Zacharevic has filed a lawsuit against AirAsia Berhad and its parent company at the time, Capital A Berhad, over the alleged unauthorised use of his iconic artwork Kids on Bicycle

Based in Penang for over 15 years, Zacharevic confirmed he filed legal action in the Kuala Lumpur High Court after discovering his artwork had been reproduced on an AirAsia aircraft livery without his consent.

According to court filings, Zacharevic discovered in October 2024 that Kids on Bicycle, a mural widely associated with George Town, Penang, had been incorporated into the external branding of an AirAsia aircraft

The aircraft, bearing the artwork, was reportedly flown on commercial routes to several international destinations before it was removed, following public objections raised by the artist.

Zacharevic maintains that the artwork was used without his knowledge, licence, or authorisation.

The artist claims this was not an isolated incident

In his statement, Zacharevic alleged that the aircraft livery was part of a broader pattern of unauthorised use by AirAsia and its affiliated entities dating back to 2016.

He claims his artworks have previously appeared across various AirAsia platforms and materials, including email campaigns, online advertisements, in-flight magazines, printed banners, and other promotional assets — all without permission, licensing arrangements, payment, or proper credit.

"This repeated behaviour sets a harmful precedent: that artists' work can be exploited without consequence," he said previously, adding that the issue affects the wider creative community, not just himself.

Zacharevic is suing for alleged copyright infringement and moral rights violations, as well as claims of passing off and unlawful interference with his trade and business interests

He is seeking declarations recognising his rights as the artist, court orders restraining further unauthorised use, the removal and destruction of infringing materials, and appropriate monetary compensation.

"I do not accept any characterisation of this use as merely a cultural or geographical reference," Zacharevic said during a press conference.

"The artwork is a distinct artistic creation — not a generic feature, but the result of many years of professional training, skill, and labour."

Zacharevic said the case was filed to let the courts independently determine the legal issues involved, noting that no findings have been made at this stage

"Any relief will be determined by the court," he said, adding that the proceedings will move forward in accordance with due process.

SAYS has reached out to AirAsia for comment. At the time of writing, the airline has yet to provide a detailed response to the allegations.
